Building Permits & Regulations

The Building Commission regulate building works in Australia. Before carrrying out any new construction or modification works you should check to see if you need a permit. Below is some information and useful links to help you.

Do I need a Building Permit ?

How do I apply for a Building Permit?

If you require a building permit you will need to apply to a private building surveyor as we no longer issue building permits. You can find a list of local building surveyors attached or visit the Building Commission website at www.buildingcommission.com.au or check the Yellow Pages under 'building surveyors'.

If you have an existing permit we have issued for you or if you have a permit currently being processed we will continue to help you with these. We can also help you with information and advice when you are preparing a building permit application for a private surveyor.

Do I need any other permits?

Planning Permit
Regardless of whether you need a building permit, you may require a planning permit. Before beginning any renovation or construction works, please contact us to check if you need a permit. More information can be found in our planning section.

Council Consent & Siting Requirements
Where a building design does not comply with the siting requirements (ResCode), you will need to apply for a 'Report and Consent' (often known as dispensation). Applications for siting dispensation are generally advertised to affected neighbours and we will notify them by mail. If an application is refused you can appeal to the Building Appeals Board.
